Terms and conditions for the provision of services

These Terms and Conditions govern the general conditions applicable to the contracting and provision of the advisory, consulting, support and management services offered by Advisa International through its website, digital channels and other enabled commercial means.
For the purposes of these Terms, Advisa International may be referred to as "Advisa" and the natural person or legal entity that contracts or requests a service as "the Client".
In addition to these Terms, the contracting of a service shall be subject to the specific conditions contained in the commercial proposal, quotation, service order, contract or equivalent document applicable to each case.
1. Purpose and scope of the services
Advisa International offers professional advisory, consulting, support and management services in the areas it has enabled and published on its official channels, including, as applicable:
- Legal services.
- Wealth and family advisory services.
- Real estate and property-related services.
- Corporate management and advisory services.
- Immigration and consular services.
- Strategic consulting and support.
- Administrative procedures and formalities.
The specific scope of each service shall depend on the commercial proposal, quotation, contract or service order accepted by the Client.
Such document may set forth, as applicable:
- Purpose of the service.
- Included activities.
- Deliverables.
- Excluded activities.
- Professional fees.
- Applicable taxes.
- Additional expenses.
- Payment method and terms.
- Estimated timeframes.
- Required information or documentation.
- Specific conditions of the service.
The publication of a service on the website does not replace the specific conditions that must be agreed upon for its contracting.
2. Formation of the contract
The information published on the website is informational and commercial in nature. The contract shall be deemed perfected in accordance with the mechanism used for each service and once the applicable conditions have been accepted and, where applicable, the agreed amount has been paid.
When the service requires a proposal, quotation, contract or service order, such document shall establish the specific conditions, which shall prevail over the general conditions solely with respect to the specific matters it governs.
Acceptance may be evidenced by a handwritten or electronic signature, digital acceptance, email, data message, proof of payment or any other legally valid mechanism that makes it possible to evidence the intent of the parties.
3. Capacity to contract
The Client declares that he or she has the legal capacity to contract.
When acting on behalf of another natural person or legal entity, the Client declares that he or she has the necessary authority to do so and shall be responsible for the truthfulness of such representation.
When a service involves a minor or another person who requires legal representation or authorization, the corresponding authority must be evidenced.
4. Prices and payment terms
Prices shall be stated in Colombian pesos (COP), unless another currency is expressly indicated.
Before contracting, the Client shall be informed of the price of the service and, where applicable, the taxes, additional expenses or items not included in the professional fees.
Payments must be made only through the channels authorized by Advisa International.
When an advance, initial payment or full payment prior to the start of the provision of the service is established, this condition must be expressly disclosed in the corresponding proposal, quotation or contracting document.
4.1. Start of the services
The start of activities may be conditional upon the agreed payment and the timely delivery of the necessary information and documentation.
When the service has actually begun, the professional fees corresponding to activities already performed, deliverables completed, formalities carried out or authorized expenses shall be governed by the specific contracted conditions and by the applicable legal provisions.
4.2. Refunds, cancellations and withdrawal
Payments may not be automatically deemed non-refundable merely because they have been made.
Requests for cancellation, refund or withdrawal shall be assessed in accordance with:
- The nature of the contracted service.
- The status of performance of the service.
- The specific conditions accepted by the Client.
- The activities actually performed.
- The expenses incurred, when legally transferable.
- The mandatory provisions of the Consumer Protection Statute and other applicable regulations.
When the right of withdrawal legally applies, it shall be respected under the terms and conditions established by Colombian law.
No provision of these Terms is intended to limit, exclude or disregard rights that cannot be waived.
5. Obligations of Advisa International
Advisa International undertakes to:
1. Provide the contracted services diligently and in accordance with the agreed scope.
2. Inform the Client of the relevant conditions of the service before contracting.
3. Maintain enabled communication channels for assistance related to the contracted services.
4. Handle the Client's personal information in accordance with the applicable Personal Data Processing Policy.
5. Promptly inform, when reasonably possible, of circumstances that may affect the performance of the service.
6. Deliver the products, documents or results expressly included in the corresponding proposal or contract.
6. Obligations of the client
The Client undertakes to:
1. Provide complete, accurate, up-to-date and verifiable information.
2. Deliver the required documents in a timely manner.
3. Report any relevant circumstance that may affect the service.
4. Respond in a timely manner to requests for information or documentation made by Advisa.
5. Comply with the agreed payment terms.
6. Review the information and documentation provided for the performance of the service.
7. Not provide false or altered information or documentation, or information or documentation of unlawful origin.
8. Promptly report any change in his or her contact details.
The late, incomplete or incorrect delivery of information by the Client may affect the performance timeframes of the service when reasonably necessary.
7. Timeframes and performance times
The times indicated by Advisa may correspond to estimated timeframes when they depend on actions, responses or decisions of third parties.
When a service depends on authorities, public or private entities, embassies, consulates, courts, notary offices, insurers, financial institutions, technology providers or other third parties, Advisa does not control the response times of such entities.
In these cases, Advisa shall inform the Client of the known conditions and shall carry out the actions that form part of the contracted service, without guaranteeing decision or response times that depend on third parties.
8. Services that depend on third-party decisions
In certain services, the final decision rests exclusively with a competent authority, entity, institution or third party.
This may occur, among others, in:
- Visa applications or consular procedures.
- Proceedings before public entities.
- Judicial or administrative proceedings.
- Notarial or registration procedures.
- Proceedings before insurers.
- Real estate transactions subject to third-party approval.
Advisa may provide advice, preparation, structuring and support in accordance with the contracted service, but does not guarantee favorable decisions when these depend on the independent assessment or decision of an authority or third party.
9. Changes to the scope of the service
Any activity not included in the proposal, quotation, contract or service order may require an additional quotation.
When the Client requests modifications, additional activities or new deliverables, Advisa may disclose in advance the corresponding additional costs, conditions and timeframes.
10. Intellectual property
The methodologies, tools, work structures, materials, designs, templates, content, technical documents and other elements developed or used by Advisa International that are eligible for intellectual property protection shall belong to Advisa or to their respective owners, as applicable.
The Client may use the final deliverables received for the purposes inherent to the contracted service, unless a different condition has been expressly agreed upon.
The reproduction, commercialization, distribution, modification or exploitation of Advisa's methodologies, materials or content for purposes other than those related to the contracted service is not authorized, when such use is protected by intellectual property rights.
11. Confidentiality
Advisa International shall treat the information provided by the Client in accordance with the applicable legal and contractual obligations.
The processing of personal data shall be carried out in accordance with the Personal Data Processing Policy of Advisa International.
When the nature of the service requires additional confidentiality obligations, these may be established by means of a contract, confidentiality agreement or other specific document.
12. Limitation of liability
Advisa International shall be liable for the obligations incumbent upon it under the contracted service and applicable law.
It shall not be liable for events, decisions, delays, actions or omissions attributable exclusively to third parties or authorities beyond its control, provided that no legal liability is attributable to Advisa.
In particular, when a result depends on the independent decision of an authority, entity or third party, the provision of the service does not imply a guarantee of a favorable result.
This provision does not limit consumer rights nor exclude liabilities that cannot legally be excluded or limited.
13. Service channels and pqr
The Client may submit requests, petitions, complaints or claims related to the services through the channels enabled by Advisa International.

Requests shall be addressed in accordance with the nature of each request and the time limits established by applicable law.
14. Personal data protection
The processing of the personal data provided by the Client shall be carried out in accordance with applicable Colombian law and the Personal Data Processing Policy of Advisa International, available on the website.
Where applicable, the Client must grant the necessary authorizations for the processing of his or her personal data.
Authorizations for commercial communications shall be separate from those necessary to handle the inquiry or provide the service.
15. Modifications and updates
Advisa International may update these Terms when necessary to reflect legal, operational or technological changes or changes in its services.
New versions shall be published on the website indicating their date of update.
Modifications shall not retroactively affect the specific conditions of services that have already been contracted, except when required by law or when there is a valid agreement between the parties.
16. Governing law
These Terms shall be governed by the applicable laws of the Republic of Colombia.
When a consumer relationship exists, the mandatory provisions of the Consumer Protection Statute and other applicable consumer protection regulations shall apply.
In the event of a conflict between a provision of these Terms and a mandatory rule, the applicable legal provision shall prevail.
17. Acceptance and record
The Client may review these Terms before contracting the service.
Acceptance may be evidenced through the legally valid mechanisms used for contracting.
When contracting takes place through electronic means, Advisa shall retain, where applicable, the supporting records that make it possible to evidence the conditions of the transaction and the acceptance given by the Client.
