When someone passes away in Colombia leaving property, the assets are not automatically transferred to the heirs. A legal process called succession is needed to recognize the heirs, list the assets and debts, and assign them legally.

Two routes: notary or court

Generally, the notary route is possible when all heirs agree on how to divide the estate. If there is disagreement, opposition or special circumstances, the process is usually judicial. Which applies depends on your case.

If you live outside Colombia

Many heirs live abroad. The process is coordinated in Colombia, and the specific steps you must take in person, if any, depend on your case.

Documents typically needed

  • Death certificate.
  • Documents proving family relationship.
  • Identity documents of the heirs.
  • Proof of the assets, such as deeds and property registry certificates.
