Advisa International guide: Divorcing in Colombia while living in the United States: what to know

If your marriage is registered in Colombia, you may need to complete the divorce proceeding there even if you live in the United States. Here is a general overview.

By mutual agreement or contested

If both spouses agree and legal requirements are met, a divorce can be processed before a notary. Without agreement, or in special circumstances, it goes before a family judge.

Marital property

The divorce dissolves the marriage, and the marital partnership enters liquidation. Assets and debts are identified and divided. This can be done in the same proceeding or later.

Children

Custody, child support and visitation should be clearly defined, always focused on the best interests of the child.

Recognition in the United States

Whether a Colombian divorce is recognized in the U.S. depends on U.S. law and your state. We do not provide U.S. legal advice, so we recommend confirming this with a U.S. attorney.
